A Sexual Abuse Lawsuit stating a former Horace Mann student was sexually abused by a music teacher accused the school of turning a blind eye to the sexual abuse to preserve its reputation as an elite prep school for wealthy families, has been settled.
A sexual abuse lawsuit filed by a former student of Horace Mann School in New Jersey has just been settled by the school, the New York Daily News reports. According to the suit, the former student was abused by a music teacher while attending the prep school several decades ago. The plaintiff was unnamed in court papers, but was the only alleged victim out of dozens of others to successfully file a suit against the school.
According to New York Daily News, Horace Mann tried to dismiss the sexual abuse lawsuit filed in New Jersey in 2013, but was unable to do so. During the course of the lawsuit, the plaintiff’s lawyer was able to dispose Horace Mann’s President Tom Kelly, but the case was settled before she was able to dispose Steven Friedman, the head of Horace Mann’s board of trustees during the alleged abuse. Friedman abruptly resigned from his position on March 14, 2015.
The New York Daily News reports that Horace Mann has been the subject of a sex abuse scandal for several years. A few years ago, multiple former students came forward making claims of sexual abuse that occurred in the 1960s and 1970s. According to The New York Daily News, the school did know of some teacher’s predatory behavior, but kept the matter quiet to preserve the school’s reputation, the suits claim.
Although over 30 students claimed past abuse, few were able to file lawsuits against the former teachers. This is due to New York’s strict statute of limitations on cases of sexual abuse. The only exception to this ruling was the case just settled, which claimed that the student was not only abused on school but also in his home located in New Jersey. New Jersey has less strict limitations for cases of sex crimes.
According to this man’s suit, he was groomed by a music teacher and molested about 450 times between 1973 and 1977. The suit claims that the former teacher forced the plaintiff to drink wine before sexual encounters, which the suit claims led to the plaintiff to take hard drugs later in life. According to the former student, the teacher convinced the boy they were “soul mates.” The plaintiff claims he did not know of any other suit against the teachers at Horace Mann until June 2014, after he had already filed his suit.
Horace Mann has awarded settlements to about 30 former students claiming sexual abuse since the New York Times ran a piece about widespread sexual abuse at Horace Man occurring between the 1960s and 1990s.
The settlement received in this latest case was not listed in court documents. Horace Mann did not comment on any other pending cases or past settlements.
